County Attorney
The County Attorney is the chief law enforcement official in Madison County and is responsible for:
Prosecuting felonies and misdemeanors under Nebraska law
Filing petitions with Juvenile Court in cases with children who are delinquent, neglected, abused, or in need of special supervision
Advising county agencies and defending civil suits brought against the county
Performing all duties of the County Coroner in death investigations
Pursuing civil commitments of individuals who are mentally ill and dangerous, including dangerous sex offenders
The Criminal Division is responsible for the prosecution of all felony and misdemeanor crimes that occur in Madison County.
The County Attorney’s Office files charges alleging violations of Nebraska law based upon the review of reports received from the city police departments, the Nebraska State Patrol, the Madison County Sheriff’s Office, or other law enforcement agencies.

The Bad Check Division is responsible for processing insufficient funds or account closed checks that have been submitted for criminal prosecution.
A victim of a bad check should submit a copy of the check along with a statutorily mandated $10.00 fee. Upon receipt of the bad check and the $10.00 fee, a statutorily mandated letter will be sent to the signer of the bad check. The signer has 10 days to pay the check plus the fee. Should the signer fail to make restitution, a follow-up letter is sent advising them of their failure and detailing their options. Failure to pay restitution will result in a criminal arrest warrant for the check writer.
The Juvenile Division is responsible for the enforcement of the Nebraska Juvenile Code. A juvenile is defined as someone who is under eighteen years of age when the relevant event occurred. To enforce the Juvenile Code, the Madison County Attorney may file a juvenile petition alleging that the juvenile is abused or neglected, that the juvenile is uncontrolled by his or her parents, that the juvenile is habitually truant from home or school, or that the juvenile is delinquent because he or she has violated a criminal law.
The Diversion Program removes first time offenders under age 21 from the Criminal Court or Juvenile Court. Individuals who wish to participate in the Madison County Diversion Program must comply with all the Diversion Program requirements to remain in and successfully complete the Program.
The Madison County Juvenile Accountability Program provides services for at-risk juveniles. The Program monitors and provides services to juveniles who have come into contact with law enforcement, who are uncontrollable by their parents, or who have school truancy issues. Juvenile Accountability also maintains a juvenile services center that offers tutoring and other educational services for juveniles during out-of-school suspensions or as a court-ordered condition.
The County Attorney has the duty to defend or prosecute, on behalf of the county, all civil suits, applications and motions arising under the laws of the State in which the County is a party or an interested party.
The County Attorney also gives legal opinions and advice to the Board of County Commissioners and other civil offices of Madison County.
The County Attorney pursues involuntary commitments of mentally ill and dangerous individuals and dangerous sex offenders before the Madison County Board of Mental Health.
The County Attorney investigates deaths that occur within Madison County under suspicious circumstances or where the cause of death is undetermined. The County Attorney has the duty to determine and certify the cause of death in such cases.
